How Much Does a DUI Cost?

When you are arrested on a DUI charge, it can be scary. There are numerous intricacies of the law that need to be taken into account. Both the criminal and traffic codes play a part in a DUI arrest and possible conviction. This can lead to some costly expenses throughout the pendency of the case and as punishment for convictions. .

Monetary Penalties for DUI Convictions 

For a first DUI misdemeanor conviction, your fines and fees are a minimum of $1,800. This includes the actual minimum fine for the conviction punishment ($390), plus all the associated fines and fees. Additionally, if you are sentenced to alcohol treatment, which is always likely, that could cost another $500. Typically for a first DUI conviction that alcohol treatment is about three months long. 

For a second DUI misdemeanor conviction, your fines and fees are a minimum of $1,800. This includes the actual minimum fine for the conviction punishment ($390), plus all the associated fines and fees. Additionally, if you are sentenced to alcohol treatment, which is always likely, it could be another $1,800 because the time ordered into the treatment increases with each DUI conviction. 

For a third DUI conviction and on, your fines and fees are a minimum of $1,800. This includes the actual minimum fine for the conviction punishment ($390), plus all the associated fines and fees. Additionally, if you are sentenced to alcohol treatment, which is always likely, it could be another $1,800 at minimum because the time ordered into the treatment increases with each DUI conviction. 

Again, these are all the minimum penalties regarding the costs associated upon conviction. It does not take into account other penalties and punishments imposed by the judge. 

There are other costs associated with DUI convictions that are very much dependent on your specific case

Other Possible Costs resulting from a DUI Conviction 

If there is property damage, you may be required to pay that back to the owner in restitution fines. 

If there is bodily harm to another, you may be required to pay that back to the injured party in restitution fines. 

After a DUI arrest or conviction, your car insurance may increase. 

If the court orders an interlock device for your care either during the pendency of the case or for a time period after conviction, that is at your own cost. An interlock device is essentially a breathalyzer device that controls the ability for you to start your car. 

Lastly, none of this takes into account the cost of an attorney. Attorneys can range in price depending on the attorney’s experience level. The price to retain an attorney can also depend on the specific circumstances of your case, the “ease” of closing the case, and whether a trial may be required to resolve the case.
