# Halloween 2026 DUI Checkpoints in Los Angeles: Your Rights and Key DMV Deadlines

Halloween 2026 falls on a Saturday. Here's what to expect from LAPD and CHP this weekend, your rights at a DUI checkpoint, the DMV deadlines if you're arrested, and why the Montclair bike-ride crash is a reminder not to drink and drive.

Halloween 2026 falls on a Saturday, which means a full weekend of parties and a lot of people deciding how they're getting home. The simple answer is the right one: if you've been drinking, don't drive. Book the rideshare, pick a sober driver, or stay over. This post covers what to expect from police in Los Angeles this weekend, and what to do if a night out ends in a DUI arrest anyway.

## A reminder from last weekend: the Montclair bike ride crash

On the night of Saturday, Oct. 24, 2026, a driver hit a group of about 30 cyclists on an informal Halloween bike ride in Montclair, in San Bernardino County. Two riders died and at least one more was seriously hurt. Police say the driver left the scene; a neighbor followed the car and helped officers find him at his home nearby, where he was arrested early Sunday, according to [FOX 11](https://www.foxla.com/news/alleged-drunk-driver-hits-bicyclists-montclair-killing-2) and [NBC Los Angeles](https://www.nbclosangeles.com/news/local/mourners-grieve-bicyclists-montclair/3961289/).

He was booked on suspicion of DUI causing injury or death, driving with a 0.08% BAC or higher causing injury or death, and felony hit-and-run. Those are allegations; he hasn't been convicted of anything. But the case shows how fast a single decision on a holiday weekend can turn into a felony case with a prison exposure measured in years, on top of the loss to the families.

Halloween night is also one of the worst nights of the year for pedestrians, with kids out after dark in costumes that are hard to see. Slow down in neighborhoods even if you're completely sober.

## Halloween drunk driving by the numbers

- 72 people died in traffic crashes nationwide on Halloween night in 2022 (6 p.m. Oct. 31 to 5:59 a.m. Nov. 1), according to [NHTSA](https://www.trafficsafetymarketing.gov/safety-topics/drunk-driving/buzzed-driving-drunk-driving/halloween).
- 39% of those deaths (28 people) were in crashes where a driver had a BAC of 0.08 or higher, per the same NHTSA data.

Those are national figures for a single night. They're the most recent Halloween-specific numbers NHTSA has published.

## What to expect from police in LA this Halloween weekend

LAPD runs DUI checkpoints and saturation patrols most weekends, and posts the schedule in its [newsroom](https://www.lapdonline.org/newsroom/). Holiday weekends usually get extra coverage, and CHP patrols the freeways. As of this writing, LAPD hadn't posted its Halloween 2026 schedule; locations are announced shortly before and can change. Assume officers will be out Friday through Sunday night.

A checkpoint and a saturation patrol work differently. At a checkpoint, officers stop cars by a set pattern at a fixed spot. On a saturation patrol, extra officers drive an area looking for signs of impaired driving and pull people over for a traffic violation first. Most holiday DUI arrests come from patrols, not checkpoints.

## Your rights at a DUI checkpoint

The California Supreme Court allowed DUI checkpoints in Ingersoll v. Palmer (1987), as long as police follow guidelines such as advance publicity, a neutral formula for which cars get stopped, supervisor-chosen locations, and short stops. If a checkpoint didn't follow those rules, evidence from it can sometimes be challenged.

- You must stop and show your license and registration when asked.
- You don't have to answer questions about where you've been or whether you've been drinking. Declining politely is fine.
- Field sobriety tests are voluntary. The roadside breath test (PAS) is voluntary if you're 21 or older and not on DUI probation.
- After an arrest, California's implied consent law ([Vehicle Code 23612](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=VEH&sectionNum=23612)) requires a breath or blood test. Refusing brings separate penalties, including a longer license suspension.
- Turning away before a checkpoint isn't illegal, but an illegal U-turn or other violation gives officers a reason to stop you.

## Arrested this Halloween weekend? Your key dates

A DUI arrest starts two separate cases: one with the DMV over your license, and one in criminal court. The DMV one has the short clock. You have 10 days from the arrest to request a hearing, or your license suspension takes effect automatically after the 30-day temporary license runs out.

- Arrest dated Fri., Oct. 30, 2026: DMV hearing request due by Mon., Nov. 9.
- Arrest dated Sat., Oct. 31, 2026: due by Tue., Nov. 10.
- Arrest dated Sun., Nov. 1, 2026 (common for after-midnight stops): due by Wed., Nov. 11. That's Veterans Day, so don't plan on doing it that day. Get it in earlier.

Go by the date printed on your notice, not the night you remember. Our guides on [requesting a DMV hearing](/blog/how-do-you-request-a-dmv-hearing-after-a-dui) and [missing the 10-day deadline](/blog/missed-10-day-dmv-hearing-deadline-dui) walk through the process.

## DMV case vs. criminal case

- DMV hearing: decides only your driving privilege. Deadline is 10 days to request it. A hearing officer, not a judge, runs it.
- Criminal court: decides guilt and penalties such as fines, probation, DUI school and possible jail. Your court date is on your citation or release paperwork.
- The two outcomes are independent. Winning one doesn't automatically win the other.

See [DMV hearing vs. criminal court](/blog/what-is-the-difference-between-a-dmv-administrative-hearing-and-criminal-court-trial-for-a-dui) for the full breakdown.

## What to do in the first few days

Request the DMV hearing. Write down everything you remember about the stop while it's fresh: where it happened, what officers said, which tests you took and when. Don't plead to anything at your first court date without talking to a lawyer. Our post on [the first 24 hours after a DUI arrest](/blog/first-24-hours-after-dui-arrest-california) has a checklist, and our pages on a [first-offense DUI](/dui/first-offense) and [California DUI penalties](/dui/penalties) explain what's typically at stake.

If someone was hurt, the case is different. DUI causing injury ([Vehicle Code 23153](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=VEH&sectionNum=23153)) can be charged as a felony, and leaving the scene of a crash with injuries is a separate crime under [Vehicle Code 20001](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=VEH&sectionNum=20001). Talk to a lawyer before talking to investigators.

## Frequently asked questions

### Will there be DUI checkpoints in Los Angeles on Halloween 2026?

Very likely, plus saturation patrols. LAPD posts its checkpoint schedule in its newsroom, usually a few days ahead, and locations can change.

### Are DUI checkpoints legal in California?

Yes. The California Supreme Court approved them in 1987, provided police follow guidelines including advance publicity, neutral selection of drivers and short stops.

### Do I have to take a breath test at a checkpoint?

Not the roadside screening test, if you're 21 or older and not on DUI probation. After an arrest, refusing the chemical test brings extra penalties.

### I was arrested on Halloween night. When is my DMV deadline?

Ten days from the arrest date on your paperwork. For Oct. 31, 2026, that's Tue., Nov. 10. For Nov. 1, it's Wed., Nov. 11, which is Veterans Day, so file earlier.

### Can I be charged with DUI for riding a bike drunk?

Cycling under the influence is a separate offense under [Vehicle Code 21200.5](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=VEH&sectionNum=21200.5). It's a misdemeanor punishable by a fine, not the same as a vehicle DUI.
